Terms of service
Last updated: 28 September 2026
These Terms of Service ("Terms") apply to your use of nicomcgowan.com (the "Site") and to every product you get from us, free or paid. By getting, buying or using a product, you agree to these Terms. If you don't agree, please don't use the Site or the products.
1. Who we are
The Site and products are provided by NØM Solutions, a sole proprietorship registered in Denmark, trading as Nico McGowan ("we", "us", "our").
- CVR number: 43387979
- Address: C/O legaldesk.dk ApS, Njalsgade 21 F, 2., 2300 København S, Denmark
- Email: support@theshowupsystem.com
2. What we offer
We make digital tools for personal development, delivered as Notion templates (the "Products"). Some are free and some are paid. Current Products include The Show Up Challenge, The Show Up System, the Identity Feed and Get Clear.
To use the Products you need your own Notion account. The Show Up System also includes the Training Architect, which is used together with an AI chat service of your choice. Notion and AI chat services are third-party services that we don't own or control, and your use of them is governed by their own terms.
3. Age
The Show Up Challenge and The Show Up System involve regular physical training and are designed for healthy adults. You must be at least 18 years old to use them.
Our other Products may be used from the age of 16. If you are under 18, you need permission from a parent or guardian to buy a Product.
4. Orders, prices and payment
Prices are shown on the Site and at checkout, including any applicable taxes. The Site may display prices in several currencies for convenience; the amount charged is the one shown at checkout. Orders and payments are processed through Fourthwall and its payment partners.
We may change our prices at any time. A price change never affects an order you have already placed.
5. Delivery
Products are delivered digitally. After checkout you can download a PDF, and for some Products you also receive an email. It contains a link that duplicates the template into your own Notion workspace, along with instructions for getting started. If you don't receive access, contact us and we'll sort it out.
6. Refunds
If a paid Product isn't for you, email us within 14 days of your purchase and we'll give you a full refund. You don't have to tell us why.
When you receive a refund, your licence to that Product ends, and you must delete your copy of it.
This refund policy comes in addition to, and does not limit, any rights you have under the consumer law of the country where you live.
7. Your licence to use the Products
When you get a Product, we give you a personal, non-exclusive, non-transferable licence to use it for your own personal, non-commercial purposes. You're welcome to duplicate and customise it inside your own Notion workspace.
You may not resell, share, redistribute, publish or give away the Products or any part of them (including templates, prompts, texts and guides), modified or not, and you may not use them to create competing products.
The licence has no end date. It ends only if you receive a refund or seriously break these Terms.
8. Health and exercise
The Show Up Challenge and The Show Up System involve physical training. Each of them opens with a Health & Safety Disclaimer that you must read and accept before you begin. That disclaimer forms part of these Terms. In short:
- The Products, including all workouts, backup options, programs and written guidance, are general fitness information for healthy adults. They are not medical, physiotherapeutic or professional fitness advice, and they don't replace professional care.
- Talk to a doctor before you begin, especially if you have an injury, a medical condition or symptoms, are pregnant or have recently given birth, take medication, or haven't exercised regularly. Don't begin if a medical professional has advised you not to exercise.
- Check how your body feels before every session. Choose a lighter option when you're sore or tired, and rest when you're injured or ill. Rest is always a valid choice.
- Stop immediately and seek medical attention if needed if you feel pain, dizziness, faintness, chest pain, shortness of breath, or anything that feels wrong. Don't exercise through pain.
- You alone decide what is safe for you to do, each day and over time, including whether each exercise suits you and at what intensity.
To the extent permitted by law, you take part in any physical activity at your own risk.
9. AI-generated training programs
The Training Architect in The Show Up System consists of prompts you paste into an AI chat service of your choice to build a training program. The programs and guidance it produces are generated by that AI service from the information you give it. They are not written by us, no one reviews your individual health before a program is generated, and a generated program is not a prescription.
AI output can be wrong, incomplete or unsuitable for you. Always check that a program makes sense for you before you follow it, and adjust or replace anything that doesn't. This also applies to programs you build or change yourself over time. If an exercise or instruction seems unsafe or unclear, don't do it.
Your use of the AI service is subject to that provider's own terms, including how it handles the information you share with it.
10. Personal development content
Get Clear and the Identity Feed are tools for reflecting on who you want to become and keeping that in view. Like the rest of our personal development material, they are not therapy, counselling or any form of medical or psychological treatment. If you're struggling with your mental health, please reach out to a qualified professional. If you're in crisis, contact your local emergency services.
11. No guaranteed results
Our descriptions reflect our own experience and how the Products are designed to work. Results depend on you and your circumstances, and we can't promise any particular outcome, physical, mental or otherwise.
12. Your content and your Notion workspace
Everything you write and collect in your copy of a Product (for example your logs, your Identity Compass or the items in your Identity Feed) lives in your own Notion workspace. It belongs to you, and we have no access to it. You're responsible for making sure you have the right to use anything you add.
You're also responsible for your Notion account and for keeping your own backups. We're not responsible for data lost because of Notion or because of changes you make to your copy.
13. Feedback
If you send us feedback or suggestions, we may use them to improve the Products without any obligation to you. We won't publish your name or quote you publicly without asking you first.
14. Our intellectual property
The Products, the Site and all their content, including templates, texts, prompts, designs and graphics, belong to us or our licensors and are protected by intellectual property law. Apart from the licence in section 7, no rights are transferred to you.
15. Third-party services
The Site and Products rely on third-party services, including Fourthwall (store and payments), Notion (templates), email providers and the AI chat service you choose. We're not responsible for the availability, changes or conduct of these services. If a third-party service changes in a way that affects a Product, we'll make reasonable efforts to update the Product, but we can't guarantee that this will always be possible.
16. Disclaimer
The Products are provided "as is". We work hard to make them useful and accurate, but we don't guarantee that they are free of errors or will meet all your needs. This does not affect any consumer rights that cannot be waived under applicable law.
17. Limitation of liability
To the extent permitted by law:
- We are not liable for indirect or consequential losses, such as lost profits, lost data or lost opportunities.
- Our total liability to you in connection with a Product is limited to the amount you paid us for that Product.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence, or liability for intent or gross negligence.
18. Changes
We may update the Products by adding, changing or removing features, and we may update these Terms. The version of the Terms in force when you placed an order applies to that order. The current version is always on this page, with the date it was last updated.
19. Governing law and disputes
These Terms are governed by Danish law, and disputes are settled by the Danish courts. If you are a consumer, this does not take away the protection of mandatory consumer law in the country where you live, or any right that law gives you to bring a case before the courts of your own country.
20. Complaints
Send complaints to support@theshowupsystem.com. If we can't resolve the issue together, you can complain to the Danish Consumer Complaints Board via Nævnenes Hus (naevneneshus.dk). If you live in another EU country, you can also get help from the European Consumer Centre in your country.
21. General
- These Terms, our Privacy Policy and the Health & Safety Disclaimers in The Show Up Challenge and The Show Up System make up the full agreement between you and us.
- If any part of these Terms is found invalid or unenforceable, the rest remains in force.
- If we don't enforce a right under these Terms straight away, we can still enforce it later.
- We may transfer our rights and obligations under these Terms to another business, for example if our business changes legal form or is sold. This will not reduce your rights.
- These Terms are written in English. If they are ever translated, the English version applies.
22. Privacy
How we handle your personal data is described in our Privacy Policy.
